Fast development of new technology poses significant challenges to the legislator (which is often incapable of keeping up with all technological developments), to practising lawyers (who have to be technically savvy and possess practical understanding of how the latest technology works), but also to technological companies that sometimes find themselves in situations in which many existing legal rules do not reflect the modern realities of new technology or the technological advancements that constantly create previously unknown problems and challenges and can entail significant legal implications.
This industry is considered as one of the major potential drivers for the Moldovan economy, and its legal regulation becomes one of the most complex and dynamically developing areas of law.
In our firm we embrace new technology and put a lot of resources and effort in understanding and learning all the latest trends in technology and its legal regulation. We believe that law should help the technological advancement for the better of people instead of becoming an obstacle to progress.
That is why we consider Telecommunications and Technology one of our key practices. We have experience of working with telecom and IT companies of various sizes operating in Moldova, providing legal advice to them, drafting relevant contracts, communicating with regulators, and representing our clients in courts.
Another important aspect of our work related to information technologies refers to the activity of Moldovan IT Parks. In 2016 the Moldovan Parliament approved the law on IT parks and in 2017 adopted a whole set of legislative amendments aimed at creating special conditions for operating IT companies in Moldova (providing significant tax benefits, simplifying registration and reporting formalities). In late December 2017 the first “Moldova IT Park” was created. In just one year more than 300 residents had registered in the park attracting more and more interest from companies and entrepreneurs from various countries of the world.
We advise companies that wish to or have already become residents of the Moldova IT park on procedures of company registration, becoming the resident of the IT park, advise on tax and other regulatory issues, provide general legal support to their activities.
Apart from helping our clients who operate in Technology and Telecommunication industry, our firm is also dedicated to the development of legal technologies (LegalTech or LawTech) which transform legal profession and practice with each passing day. Frequent threats are voiced about the influence of artificial intelligence and new information systems on the future of lawyers who can soon find themselves without a job because of the technologies encroachment on the profession. Some of these threats may turn realistic as more and more news keep reported about computers that are not only capable of doing certain types of legal work, but actually doing it better than humans. Lawyers will have to constantly adapt to these technological advancements and identify their role in the fast-changing world in order to remain in the profession and find new solutions for their clients that robots will not be able to do.
